Forest Land Tenure Conflicts and Their Resolutions: A Case Study from Musi Rawas Regency, South Sumatera Province

The implementation of land tenure policy since the colonial era until the New Order era has been leaving many unresolved tenure conflicts across Indonesia. A Rapid Land Tenure Assessment (RaTA) method was used to map the conflicts and to facilitate conflict resolution based on: actors involved demands of right, conflicts existence as well as direct and indirect causes. Based on actors involved, conflicts occurred between society with Production Forest Management Unit (PFMU) of Lakitan and society with forest concession holder. Conflicts can be grouped into two categories based on demands of right, viz.: the property right and access conflicts. Based on presence of conflicts, there were closed (latent), escalated (emerging) and opened (manifest) conflicts. This study founds five indirect reasons as the causes for those conflicts, specifically the absence of manager at the site level, legal dualism on land regulation, different perceptions about the forest, different value about the land and government’s programs. Furthermore, there were three direct causes found in the area, i.e. forest boundary marking, claims by forest concession holder and PFMU over community’s land and claims by the community over forest areas. In today’s reform era, resolution of conflicts concerning forest’s land seems to be unfair, particularly in the allocation of land resources. The implementation of adaptive governance in order to manage the common-pool resources (CPRs) could influence its security and sustainability. Land ownership concept according to the Islamic perspective was proposed as alternative for conflict resolution.
